By creating an account or using the Service you agree to be bound by these Terms. If you are accepting on behalf of a company, you represent that you have the authority to bind that company.
Fika provides an automated social media management platform that includes content generation, multi-platform scheduling, analytics reporting, and related features. The specific features available to you depend on the subscription plan you have selected.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.
You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@usefika.com if you suspect unauthorised access.
Accounts are for a single business entity. You may not share your account with other organisations or resell access to the Service without our written consent.
The Service is offered on a monthly subscription basis across three tiers: Presence, Growth, and Scale. Plan details, including post limits, platform access, and included features, are described on our pricing page.
Each plan includes a 14-day free trial. No credit card is required to start a trial. During the trial you have full access to the features included in your chosen plan. If you do not subscribe before the trial period ends, your access to the Service will be suspended and no charges will be incurred. We reserve the right to modify or discontinue free trials at any time.
Subscriptions are billed monthly in advance. By providing payment details you authorise us to charge the applicable fees on each billing date. All fees are in US dollars and are non-refundable except as required by law or as expressly set out in these Terms.
If payment fails, we will notify you and may suspend access to the Service after a 7-day grace period. Accounts suspended for non-payment for more than 30 days may be terminated and data deleted in accordance with our data retention policy.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access until that date and will not receive a pro-rata refund for the remainder of the period. If you cancel during your free trial, no charges will be incurred and your access will end immediately.
We may change subscription prices with at least 30 days' written notice. Continued use of the Service after the new price takes effect constitutes acceptance of the new pricing.

You retain ownership of all brand data, guidelines, and approved content you upload or generate through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive licence to process Your Content solely to deliver the Service to you.
Content generated by our AI is produced on your behalf using your brand data. You are responsible for reviewing, approving, and publishing automated content. Fika makes no warranty that automated content is free from errors, appropriate for your audience, or compliant with platform policies.
The Service, including its software, design, and underlying AI systems, is owned by Fika and protected by intellectual property laws. Nothing in these Terms grants you any rights in the Service beyond those expressly stated.
If you provide feedback or suggestions about the Service, you grant us an irrevocable, royalty-free right to use that feedback for any purpose without compensation to you.
The Service integrates with third-party platforms (LinkedIn, Twitter / X, Facebook) and AI providers (Anthropic, OpenAI). Your use of those platforms is governed by their own terms of service. Fika is not responsible for changes to third-party APIs, platform policy enforcement, or content removal decisions made by social platforms.
Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service you consent to the data practices described therein.
Each party agrees to keep confidential any non-public information of the other party that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIKA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT WILL FIKA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR THE SERVICE EXCEED THE FEES YOU PAID TO FIKA IN THE 3 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Fika and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) Your Content; or (c) your violation of any third-party right.
These Terms begin when you first access the Service and continue until terminated. Either party may terminate for convenience with 30 days' notice. We may terminate immediately if you breach these Terms, engage in fraud, or violate applicable law.
Upon termination, your right to access the Service ends. We will retain your data for 90 days to allow export, after which it will be deleted in accordance with our Privacy Policy.
These Terms are governed by the laws of England and Wales without regard to conflict of law principles. Any dispute arising from these Terms will first be submitted to mediation. If mediation fails, disputes will be resolved by the courts of England and Wales, and you consent to their exclusive jurisdiction.
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before the changes take effect. Continued use of the Service after changes are in effect constitutes acceptance of the updated Terms.
